I was playing a game the other day 2250pts against someone. After the game I work his army cost to be around the 2600pt mark, you ask how I know this, well i remember the army very well & it is a force I hold dear to my heart. Do you mention it to the opponent the next time you see him or just keep quite, ask for an army list in future. My question to you is what would you do? p.s I still won

I'd say to the oppent so they would not do this in future games.
But on the other side if a person was cheating (not saying the oppent did just stuff happen to me) then I WILL ask to see a army list or ask them to write one down & then I'll play them.
But again I just say to the oppent just for future ref. Should be nothing wrong

Personally I probably wouldn't mention it to him from out of the blue. I'd wait until the next time you played him and when all is deployed and it's the same illegal army on the table you'd be in a much stronger position to have the conversation. The evidence would be there in a more irrefutable way. Having the conversation without the armies deployed could lead to a far more vague claim and counter-claim type of argument which wouldn't be ideal.
I would jot down a few notes for your own benefit regarding points etc ahead of time and when the army is out on the table you can be in a position to raise your eyebrows and question his army from a much firmer standpoint. You can simply point out "300pts for them, 500pts for them, 400pts for them etc all adds up to about 2600pts..."
A conversation from out of the blue, without the armies on the table will probably just lead to him seeking to bluff his way out of it, which might not be a very satisfactory conversation.

I've been in the same situation Neil - not at Stirling I might add! When I was a bit of a newb a DE army I could never beat, and even though I was playing against it with HE he seemed to fit everything in his army that I couldn't. Basically did what Paul suggests but, to be honest, I never played him much again as, if he brings this attitude to the game then it doesn't matter what army he brings, they still won't be an enjoyable opponent. He wasn't, and when my models started disappearing a couple at a time at each game, that was the end. On the other hand I once knew this bloke who brought a BSB-general and a free eagle to a tournament final!!!

Knowing who your talking about I'm pretty sure he wouldn't need or want to be 400 points over deliberately but it is a pretty bad and unusual mistake to make. I'd probably just let him know, he'd most likely be thankful for it.

I generally believe 400 points isn't a mistake. A mistake is adding up for magic items allowance, or being ~20 points over, simply coz you forgot you needed to trim one spearman off a unit to allow something else when you change a long standing list.

I'm with Asurya on this one, 400pts isn't a mistake.
What i would say with this is though. Was your opponent a relativly new player? If so then that would make it an easier to approach them over the matter as they may just have been a bit over enthusiastic and miscounted possibly by not adding the figures for an entire unit or character.
If it was a known cheat or a regular opponent that never beats you and was trying to cheat to actually manage it then thats a different manner, that's what spiky baseball bats are for ;D

400pts is a Dragon, or a Daemon Prince, or one and a half Steam Tanks! Not the sort of points that anyone can claim is an error.

I have spoke to the person & he says it was a genuine mistake, I believe him as I play him on a frequent basis & is a really nice guy.

Just end of the day you don't want them useing a over/under-pointed list in the event they plan on entering a event or just in general. End day we all make mistakes ;D Jamie
